Terms and Conditions of Service

This document constitutes the binding legal agreement ("Agreement") between the User ("Client", "You") and the ProleadSync platform ("We", "Company"), managed in Portugal by the registered owner of the trademark. By browsing proleadsync.com, registering a free account, or subscribing to a paid plan, the User declares to have read, understood, and fully accepted these Terms and Conditions.

1. Definition and Limits of the Service

ProleadSync is marketed as an intelligence technological platform oriented towards the Instagram social network. Our software analyzes thousands of public data points to structure profiles and generate metrics of potential commercial interest.

What we do not do: In total rejection of obscure practices, the platform declares that it does not perform direct message sending automations, does not interact automatically with posts (likes, comments), and does not hide its digital identity by recurring to botnet networks. We are an analytical lens, not a spam execution tool ("No messaging. No replacing Instagram. Just actionable intelligence.").

Declaration of Independence: ProleadSync is an independent product, completely detached from any corporate relationship, sponsorship, licensing, or endorsement by Meta Platforms, Inc. The use of third-party registered trademarks has purely nominative purposes.

2. Access and Registration Conditions

The ability to enjoy features such as unlimited searches and structured summaries requires the prior creation of an account. The User guarantees, under penalty of immediate suspension and without the right to a refund, that:

They are 18 years of age or older or have full capacity to exercise commercial acts.
The data provided at the time of registration are authentic and up to date.
The account is strictly for personal use or non-transferable outside the scope of their direct team (subject to the profile limit of the subscribed plan), being solely responsible for the security of their password.

3. Plans, Billing, and Trial Periods

Joining the software is based on a Software-as-a-Service (SaaS) model, flexibilized to meet the needs of independent professionals and companies.

Trial Period (15-Day Free Trial): Occasionally, we offer a full 15-day evaluation period. After the 15 days, access to premium features is automatically suspended, unless the User affirmatively and deliberately chooses to transition to a paid plan.
Free Plan (€0/month): Intended for users in the discovery phase, it includes unlimited profile searches, a limit of 90 summary analyses per month, 5 deep analyses per month, limited alerts via Telegram, and reports restricted to 1 profile.
Professional Plan (Pro Plan - €19.99/month): Designed for "active freelancers and consultants", it unlocks the operational limit of the tool as explicitly detailed in the updated pricing table on the website.

Payment Mechanics: By subscribing to the Pro Plan, the User authorizes the monthly charge of €19.99 (including legally applicable VAT rates in Portugal) through the provided payment method. The subscription renews automatically at the end of each billing cycle, unless previously canceled.

4. Acceptable Use and Intellectual Property

All interface structural code, reading algorithms, logos (including the PROLEADSYNC word mark - INPI nº 761137), and server infrastructure are the inalienable intellectual property of the Company. The User is strictly forbidden to:

Attempt to reverse engineer, decompile, or extract the source code of the platform.
Sublicense, resell, or act as a commercial intermediary in the sale of direct access to ProleadSync without written authorization.
Use the data generated by our intelligence for illegal commercial practices, online stalking, or defamation.

ProleadSync does not claim copyright over the information extracted from social networks; those rights belong to their respective owners in accordance with the original platform's terms.

5. Disclaimer of Warranties and Limitation of Liability

Removing legal noise requires clarity on warranties. ProleadSync acts under an obligation of means, not results.

Our promise to mitigate uncertainty and structure data ("reduces uncertainty, removes guesswork") does not constitute, under any framework, a legal guarantee of financial profit generation or sales realization.

The Platform depends critically on the accessibility and policies of Meta Platforms, Inc. Therefore, we assume no responsibility, nor do we offer compensation, in the event that Instagram changes its technical infrastructure in a way that temporarily or permanently prevents our extraction process, or if the User's personal Instagram account is penalized by the respective network.

To the maximum extent permitted by applicable law, ProleadSync's cumulative financial liability for any direct damages arising from the provision of the service shall be strictly limited to the total amount paid by the User during the three (3) months of subscription immediately preceding the occurrence of the claimed damage.

6. Applicable Law and Jurisdiction

The constitution, validity, and interpretation of these Terms are governed by Portuguese substantive law. In the event of a dispute that cannot be resolved amicably through our commercial support, the exclusive jurisdiction of the District Court of Lisbon is stipulated, with express waiver of any other forum, without prejudice to imperative consumer protection rules that impose a different forum.
